Are all CBD products considered legal?

CBD and Delta-8 products are considered legal hemp products in some states as long as the substance is extracted from hemp and contains no more than 0.3% THC. In addition to this, the source (hemp plant) must be grown by licensed farmers in accordance with state and federal regulations.

Mississippi – Allows the use of CBD oil and products with less than 0.3% THC levels as determined by the FDA. Medical patients can use CBD at higher concentrations of up to 0.5%.

Kentucky – Excluded the word “marijuana” when defining CBD products for medical use. CBD oil is legal for use as well as long as it has less than 0.3% THC.

Kansas – Legal to use CBD products if approved by the FDA. CBD products below 5% THC levels are also legal for medical use.

Iowa – CBD products are legal if they are in accordance with chapter 124E of the Iowa Code.

Indiana – Legal to use CBD oil with no other controlled substances as well as having below 0.3% THC levels.

Alabama – CBD products approved by the FDA and have less than 0.3% THC levels are legal for recreational use.

Oklahoma – Excluded the word “marijuana” when it comes to defining CBD products approved by the FDA. CBD oil and products are legal as well as long as it’s approved by the FDA and has less than 0.3% THC.

South Dakota – CBD has recently been legalized. As long as the CBD product is approved by the FDA, it is legal.

South Carolina – CBD products are legal in South Carolina as long as it’s below 0.3% THC. Additionally, CBD for medical use is legal as long as it’s below 0.9% THC levels.

North Carolina – Illegal to grow hemp but allowed for medical use as long as it has less than 0.9% THC.

Utah – Legal to use CBD oil with less than 0.3% THC. CBD edibles are illegal with the exception of gelatin cubes.

Texas – The use of CBD products is legal if it’s below 0.3% THC. However, CBD for medical use is legal as long as it’s below 0.5% THC levels.

Virginia – CBD is legal if it is obtained legally and if it follows FDA guidelines. Medical conditions also allow for the use of CBD not more than 0.5% THC.

The law is unclear on whether CBD products are legal or not in Wisconsin. If you reside in the area or plan to stay there for some time, it’s important to note that possession of CBD products is considered a misdemeanor and is punishable by a jail sentence. However, the attorney general did advise law enforcement to not enforce this law. If you plan to use a d8 hemp cigar or other CBD products while in Wisconsin, it’s highly recommended that you secure a physician’s certificate.

Whichever state you source your products from, it’s important to always check the product details to make sure that you’re buying the product that is appropriate for your intended use before purchasing any CBD or delta-8 product. Whether it’s for medical or recreational purposes, it won’t hurt to be cautious when it comes to these products you consume to avoid any issues.

When buying CBD products, always remember that CBD can be extracted from both cannabis and industrial hemp plants. While there are similarities between these plants, they are often treated differently when they are used or added as ingredients to certain products or medications. Only hemp-derived CBD products are considered to be legal federally. The use of CBD products containing levels of THC above .3% is still considered illegal in certain states.
